Acceptable Use Policy (AUP) for Domains and IP Management

This AUP governs your use of any Hosted Domains and IP Management Services provided by OPTIZMO Technologies, LLC (“OPTIZMO,” “Company,” “we,” or “us”) in connection with your SUPPRESS account. By using these Services, you (“Customer” or “You”) agree to comply with this AUP, U.S. law (including the CAN-SPAM Act of 2003), and all other applicable regulations.


1. Lawful Use Only

1.1 Permitted Use. Services may only be used to manage and maintain email-compliance programs in full accordance with U.S. law.
1.2 Termination for Liability. We reserve the right to suspend or terminate Services immediately if your activities expose us to legal liability or threaten our ability to serve others.
1.3 Indemnification. You agree to indemnify and hold us harmless from any claims arising out of your use of the Services.


2. Prohibited Content & Activities

2.1 Illegal or Harmful Use. You may not publish or distribute content that is unlawful, harmful, fraudulent, or violates any applicable law. This includes, but is not limited to:

  • Disclosing sensitive personal data without consent
  • Distributing malware or malicious code
  • Hosting or linking to child pornography (we will report to law enforcement/NCMEC)
  • Phishing, identity theft, money laundering, or gambling operations
  • Hosting sites intended to deceive or endanger public safety

2.2 Unauthorized Access & Network Abuse. You may not use our Services to:

  • Probe, scan, or breach security of any network without permission
  • Launch Denial-of-Service (DoS) or similar attacks
  • Intercept or monitor data not intended for you

2.3 Resource Abuse. Excessive consumption of server resources—beyond normal usage—may be curtailed or blocked. Any scripts or processes that degrade system performance are prohibited.


3. Zero-Tolerance Spam Policy

3.1 CAN-SPAM Compliance. We enforce a zero-tolerance stance on unsolicited bulk or commercial email that violates the U.S. CAN-SPAM Act of 2003 (“Spam”).
3.2 No Spamvertising. Domains or IPs used to spam-advertise (including fax, phone, postal, email, IM, or newsgroups) will be suspended or terminated.
3.3 Blacklist Response. Any Customer whose IP space is blacklisted must immediately provision their own domains/IPs or face suspension.
3.4 ROKSO Ban. Entities listed in the Register of Known Spam Operations may not use our Domain/IP Hosting or Monitoring services.

4. Defamation & Objectionable Content

4.1 Freedom & Respect. We support free expression but expect respectful content.
4.2 Defamation Claims. We require a valid court order to remove alleged defamatory or objectionable content from hosted opt-out pages or domains—unless immediate removal is necessary to prevent harm.


5. Messaging Compliance (A2P & TCPA)

5.1 SMS/MMS Usage. If you send SMS/MMS traffic via our hosted domains or IPs, you must comply with:

  • TCPA: Telephone Consumer Protection Act (no autodialed or prerecorded messages without prior express consent).
  • A2P 10DLC: Carrier registration, opt-in/opt-out, HELP/STOP mechanics.

5.2 Opt-In/Opt-Out Requirements.

  • Maintain documented, affirmative opt-ins.
  • Provide clear opt-out instructions (“Reply STOP”).
  • Honor STOP immediately; confirm with a final message.
  • Offer HELP instructions in every message.

5.3 Carrier Blacklisting. Non-compliant traffic risks carrier blocking; any blacklist event will trigger immediate suspension of Services.


6. Enforcement & Remedies

6.1 Immediate Action. We may disable Services or remove content—without notice—for any violation.
6.2 Compliance Response. If we contact you about a violation, you must respond within 48 hours. Failure to do so may lead to suspension or termination.
6.3 Law Enforcement. Violations may be reported to appropriate agencies.


7. Changes to This AUP

We may update this AUP at any time by posting the revised version. Continued use of Services after posting constitutes acceptance of the changes.
